Terms of Service
1. Scope of Service
VR Anywhere, owned by Upticker, Inc. ("The Company") provides mobile Virtual Reality (VR) and Mixed Reality (MR) experiences at locations designated by the Client. The Company provides equipment, setup, and on-site technical supervision ("Technicians"). By booking or participating in a VR Anywhere event, you agree to be bound by these Terms.
2. Location Suitability & Safety
- Space Requirements: The Client is responsible for providing a clear, hazard-free, indoor/shaded area of at least 6ft × 6ft per active user. The area must be free of obstacles, sharp objects, and tripping hazards.
- Environment: For outdoor events, the area must be fully shaded. Direct sunlight on VR lenses causes permanent screen damage (burn-in). We strictly prohibit use in rain or wet conditions.
- Right of Refusal: Technicians reserve the right to halt services without a refund if the environment is deemed unsafe (e.g., uneven flooring, presence of pets/small children in the play zone, intoxicated guests, or extreme weather).
- Property Damage: The Company is not liable for any damage to Client's or public property, caused by the Equipment, or by the Client, guests, including those not engaging in the VR experience.
3. Equipment Liability
- Damage/Loss: The Client assumes full financial responsibility for the equipment from the moment of setup until the Technician begins teardown. The Client is liable for any damage, loss, or theft occurred during the event.
- Replacement Fees: Damage caused by Client negligence (e.g., dropping a headset, sunlight damage, liquid spills, physical abuse, among others) will be charged at the Full MSRP Replacement Value per unit, including accessories.
4. Meta Platforms & Commercial Compliance
- Commercial Terms: By using our Meta Quest equipment, you agree to comply with Meta’s Supplemental Terms of Service and Horizon Managed Services Terms.
- Software Licensing: All software is licensed via commercial LBE (Location-Based Entertainment) agreements. Clients may not attempt to install personal software, modify settings, or access personal Meta accounts on Company devices.
5. Health & Safety Waiver (Inherent Risks)
- Acknowledgment of Risk: VR/MR can cause motion sickness, disorientation, seizures, and physical injury (e.g., striking objects/walls). Users are effectively "blind" to the real world while in VR.
- Medical Disclaimer: Use is not recommended for those with heart conditions, severe anxiety, epilepsy, or a history of seizures. Pregnant women should consult a physician before use.
- Age Restriction: All participants must meet the minimum age requirements per the software and hardware manufacturers guidelines. Use by children under 13 is generally not recommended. Minors under 18 must have a waiver signed by a parent or legal guardian. For additional information regarding Meta's child safety, please visit Meta Quest Parent Info.
- Physical Assistance: If members of the Company's staff help guests put on headsets, this is considered necessary physical contact to ensure the proper use of the equipment and participants safety. The Client agrees to release the Company and its staff from any claims related to such physical contact.
- Prohibited Use: You are not allowed to use the hardware for any illegal or harmful purposes.
- Participant Waiver: Before participating in the VR experience, each participant must sign a waiver available here.
6. Logistics & Payments
- Travel & Setup Fees: Costs associated with travel of staff and equipment are non-refundable.
- Public Space Permits: If the event is held in a public space, the client is responsible for obtaining any necessary permits or "Right of Entry" documents.
7. Booking
- In order to secure your date and time, payment must be received within 12 hours of booking. If payment is not received within 12 hours, the booking will be automatically cancelled.
- You may reschedule your event up to 24 hours before the event using the links provided in your email invitation. Changes to the booking are not guaranteed and are subject to availability of the requested date and time. Please make your request as soon as possible to allow us the best opportunity to accommodate your needs.
The Company reserves the right to cancel or reschedule an event due to unforeseen circumstances, including but not limited to, severe weather conditions, equipment malfunction, or staff illness. In such cases, the Client will be offered a full refund or a credit for a future event.
8. Cancellation Policy
- If you cancel your event more than 72 hours before the event, you are eligible for a full refund or a full credit for a future event.
- If you cancel your event between 24 and 72 hours before the event, a $50 cancellation fee will be deducted from your original payment and the balance will go towards a credit for a future event.
- Cancellations made less than 24 hours before the event, or no-shows, are not eligible for a refund nor a credit for a future event.
- You may cancel your event using the links provided in your email invitation.
9. Limitation of Liability
To the maximum extent permitted by applicable law, The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. In no event shall The Company's aggregate liability exceed the amount paid by the Client for the specific event giving rise to the claim.
The Company is not responsible for any personal injuries, damages or losses that may occur during the event. The Client assumes all risks associated with the use of the VR equipment and agrees to indemnify and hold harmless The Company from any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; or (c) any injury or damage occasioned by the Client's guests or event attendees.
10. Indemnification
The Client agrees to indemnify, defend, and hold harmless The Company, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; or (c) any injury or damage occasioned by the Client's guests or event attendees.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Florida, and the parties hereby consent to the personal jurisdiction and venue therein.
